The content copyright is just another way to protect the IP wrt the content.  And copyscape.com does the job of identifying duplicate content (content copyright violation) across the websites.

Incase of any content copyright violation, google would not penalize the site directly.  however, google has some mechanism to identify the genuine site and give higher weightage for ranking.  However, when the owner of the content files a lawsuite, then the penalty is wrt the discretion of the jurisdiction. Go ahead and use copyscape to find out which are the pages in your site that duplicates an existing page.
